公共數據是重要的社會公有財富,與人民群眾生活息息相關。有效利用公共數據已成為各國推進數字化轉型發展的焦點。提高公共數據資源開發利用水平,有利于加快傳統產業轉型升級,優化(hua)經濟結(jie)構和(he)運行(xing)機制,有利(li)于激發市場(chang)創新(xin)活(huo)力,培育數據產(chan)業,形成新(xin)的(de)經濟增長點,有利(li)于加(jia)快政(zheng)府職能(neng)轉變,推進(jin)國(guo)家治(zhi)理體(ti)系和(he)治(zhi)理能(neng)力現代(dai)化(hua)。

黨(dang)中央、國(guo)(guo)務(wu)院高度重視公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)資(zi)源(yuan)(yuan)開(kai)發(fa)(fa)(fa)利(li)用。習近(jin)平(ping)總(zong)書記指(zhi)出,“數(shu)(shu)據(ju)(ju)是新的(de)(de)生產要素(su),是基礎性(xing)資(zi)源(yuan)(yuan)和(he)戰(zhan)略性(xing)資(zi)源(yuan)(yuan),也(ye)是重要生產力”。黨(dang)的(de)(de)二十(shi)屆三中全(quan)會高度關注數(shu)(shu)據(ju)(ju)要素(su),提(ti)出“建設和(he)運營國(guo)(guo)家數(shu)(shu)據(ju)(ju)基礎設施,促進(jin)數(shu)(shu)據(ju)(ju)共(gong)(gong)(gong)享”“培育全(quan)國(guo)(guo)一(yi)體(ti)化(hua)技術和(he)數(shu)(shu)據(ju)(ju)市(shi)場”。地方層(ceng)面,2020年上海、江蘇、浙(zhe)江等(deng)8個地區組(zu)織(zhi)開(kai)展為期兩(liang)年的(de)(de)公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)資(zi)源(yuan)(yuan)開(kai)發(fa)(fa)(fa)利(li)用試點工作,取得(de)了預期效果;全(quan)國(guo)(guo)公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)開(kai)放水平(ping)也(ye)在(zai)不斷提(ti)高,開(kai)放公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)集數(shu)(shu)量持(chi)續增(zeng)長;部分有條件的(de)(de)地區、部門開(kai)展了公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)授權(quan)運營實踐。但總(zong)體(ti)來看,公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)資(zi)源(yuan)(yuan)開(kai)發(fa)(fa)(fa)利(li)用還面臨著思想認識不統一(yi)、安(an)全(quan)權(quan)責(ze)不清晰及開(kai)發(fa)(fa)(fa)動力不充沛(pei)等(deng)諸多挑戰(zhan)。針對這些突出問題,國(guo)(guo)家層(ceng)面亟需(xu)加強政策引導(dao),完善制度規則(ze),加快公(gong)(gong)共(gong)(gong)(gong)數(shu)(shu)據(ju)(ju)資(zi)源(yuan)(yuan)開(kai)發(fa)(fa)(fa)利(li)用。

2024年10月9日,《中(zhong)(zhong)共(gong)(gong)(gong)中(zhong)(zhong)央(yang)辦(ban)公(gong)廳(ting)、國(guo)務院辦(ban)公(gong)廳(ting)關于加(jia)快公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)開(kai)發(fa)(fa)利用(yong)(yong)(yong)的意見(jian)》(以(yi)下(xia)簡稱(cheng)《意見(jian)》)公(gong)開(kai)發(fa)(fa)布。《意見(jian)》是中(zhong)(zhong)央(yang)層面首次(ci)對(dui)公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)開(kai)發(fa)(fa)利用(yong)(yong)(yong)進行系統部署,是貫徹落實黨的二十屆三中(zhong)(zhong)全會精神的重要(yao)(yao)舉措(cuo)(cuo),也是我國(guo)數據(ju)(ju)(ju)(ju)(ju)基(ji)(ji)礎制度建設(she)的重要(yao)(yao)內容,對(dui)公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)開(kai)發(fa)(fa)利用(yong)(yong)(yong)具(ju)有里程(cheng)碑意義。該文件以(yi)促進公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)合規(gui)高效流通(tong)使用(yong)(yong)(yong)為主線,以(yi)提(ti)高資(zi)(zi)源(yuan)開(kai)發(fa)(fa)利用(yong)(yong)(yong)水(shui)平(ping)為目(mu)標(biao),以(yi)“激發(fa)(fa)共(gong)(gong)(gong)享開(kai)放動力(li)”和“釋放市場創新活力(li)”雙力(li)齊發(fa)(fa),持續深化公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)供給側結(jie)構性(xing)改革(ge),以(yi)規(gui)范(fan)公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)授(shou)權(quan)運營為重要(yao)(yao)抓手(shou),以(yi)擴大資(zi)(zi)源(yuan)供給、規(gui)范(fan)授(shou)權(quan)運營、鼓勵(li)應用(yong)(yong)(yong)創新、營造(zao)良好環(huan)境、強化組(zu)織保障等五措(cuo)(cuo)并舉,提(ti)出了17項具(ju)體措(cuo)(cuo)施,打通(tong)公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)流通(tong)使用(yong)(yong)(yong)雙循(xun)環(huan),充分發(fa)(fa)揮公(gong)共(gong)(gong)(gong)數據(ju)(ju)(ju)(ju)(ju)的基(ji)(ji)礎性(xing)、先導性(xing)作用(yong)(yong)(yong),推(tui)動數字(zi)經濟高質量發(fa)(fa)展。

堅持雙力齊(qi)發,打(da)造數字經(jing)濟發展的核心(xin)動能

《意見(jian)》指(zhi)出(chu),公(gong)共數(shu)(shu)據是(shi)(shi)國家重要的基礎性戰略資源,提高公(gong)共數(shu)(shu)據資源開(kai)(kai)發(fa)(fa)利(li)(li)用水(shui)平(ping),是(shi)(shi)深化(hua)數(shu)(shu)據要素(su)市場(chang)化(hua)配置改革(ge)的關鍵(jian)舉措(cuo)。同時(shi),《意見(jian)》強調(diao)在推動公(gong)共數(shu)(shu)據資源開(kai)(kai)發(fa)(fa)利(li)(li)用中(zhong),要“激發(fa)(fa)共享開(kai)(kai)放動力(li)”和“釋放市場(chang)創(chuang)新(xin)(xin)活力(li)”。這實際(ji)上明(ming)確(que)了(le)數(shu)(shu)字(zi)經濟發(fa)(fa)展的兩個核心動力(li)——公(gong)共數(shu)(shu)據資源有效(xiao)供(gong)給和創(chuang)新(xin)(xin)應用,這也是(shi)(shi)解決當前數(shu)(shu)字(zi)經濟發(fa)(fa)展中(zhong)供(gong)需不(bu)匹(pi)配問題的關鍵(jian)。

在數據需求應用方面,當前也面臨有效需求不足的問題,特別是有經濟價值的應用場景十分有限。《意見》中從豐富數據應用場景、推動區域數據協作、加強數據服務能力建設、繁榮數據產業發展生態等方面提出具體要求。其中,在豐富數據應用場景方面,《意見》從兩個“鼓勵”和一個“堅持”三個維度提出要“在市場需求大、數據資源多的行業和領域,拓展應用場景”。凸顯應用場景導向,加大“數據要素×”行動力度,鼓勵經營主體利用公共數據資源開發產品、提供服務,推動行業和領域公共數據價值實現;鼓勵和支持企事業單位和社會組織有條件無償使用公共數據開發公益產品,提供便民利民服務;支持人工智能政務服務大模型開發、訓練和應用。這充分釋放了鼓勵企業利用公共數據實現經濟價值的信號,為打通數據應用商業閉環、激發市場創新活力提供了依據。公共數據資源只有與千行百業深入融合才能發揮真正的作用,公共數據資源如同豐富的原材料,各類數據應用場景則是將這些原材料點石成金的大熔爐,必須圍繞國民經濟社會發展、百姓衣食住行、城市社會治理、戰略性新興產業等具體(ti)化小切口(kou)場景為(wei)突破,以“降(jiang)本(ben)提質增效”為(wei)核心,推動數據利用方式向共享匯(hui)聚和(he)應用服務能力并重的(de)方向轉變(bian),促進(jin)多元數據融合應用,豐富數據產品和(he)服務。

規范授權運營,建立合規高效流通(tong)的(de)關鍵機(ji)制

作為(wei)促進(jin)公(gong)(gong)共數(shu)據(ju)(ju)合規高效(xiao)流通使用的(de)(de)關(guan)鍵機制(zhi)(zhi),《意(yi)見》對(dui)授(shou)權(quan)運營(ying)進(jin)行(xing)了深入描述,這(zhe)一機制(zhi)(zhi)也貫穿于(yu)《意(yi)見》擴大供(gong)給、規范運營(ying)、鼓勵(li)創新(xin)、營(ying)造環境、強化(hua)保(bao)障等五方(fang)(fang)面措施的(de)(de)始(shi)終,將對(dui)各(ge)地方(fang)(fang)各(ge)部門開展公(gong)(gong)共數(shu)據(ju)(ju)授(shou)權(quan)運營(ying)工作給予指導。關(guan)于(yu)公(gong)(gong)共數(shu)據(ju)(ju)授(shou)權(quan)運營(ying)機制(zhi)(zhi),目前已經有部分地方(fang)(fang)和(he)部門開展了相(xiang)關(guan)實(shi)踐探索。《意(yi)見》在(zai)給出指導性要求(qiu)的(de)(de)同時,也給予了各(ge)地各(ge)部門創新(xin)探索的(de)(de)空(kong)間。10月12日,國家(jia)數(shu)據(ju)(ju)局(ju)就《公(gong)(gong)共數(shu)據(ju)(ju)資源授(shou)權(quan)運營(ying)實(shi)施規范(試行(xing))》(以下簡(jian)稱《實(shi)施規范》)面向公(gong)(gong)眾公(gong)(gong)開征(zheng)求(qiu)意(yi)見,該文件對(dui)于(yu)授(shou)權(quan)運營(ying)機制(zhi)(zhi)的(de)(de)落地實(shi)施給出了明確要求(qiu)。

細化運(yun)(yun)營要(yao)求(qiu)。《意見(jian)》明(ming)(ming)確(que)要(yao)求(qiu)各地(di)各部(bu)門“加強對授(shou)(shou)權(quan)(quan)運(yun)(yun)營工(gong)作(zuo)的(de)(de)統(tong)籌管(guan)(guan)理(li)(li)(li),明(ming)(ming)確(que)數(shu)據(ju)管(guan)(guan)理(li)(li)(li)機(ji)(ji)構(gou)(gou),將授(shou)(shou)權(quan)(quan)運(yun)(yun)營納入‘三重一(yi)大’決策范(fan)圍”。《意見(jian)》對數(shu)據(ju)管(guan)(guan)理(li)(li)(li)機(ji)(ji)構(gou)(gou)、運(yun)(yun)營機(ji)(ji)構(gou)(gou)的(de)(de)職(zhi)責以(yi)(yi)及授(shou)(shou)權(quan)(quan)運(yun)(yun)營模式給出(chu)指導(dao),明(ming)(ming)確(que)提出(chu)“數(shu)據(ju)管(guan)(guan)理(li)(li)(li)機(ji)(ji)構(gou)(gou)要(yao)履行(xing)行(xing)業監(jian)管(guan)(guan)職(zhi)責,指導(dao)監(jian)督運(yun)(yun)營機(ji)(ji)構(gou)(gou)依(yi)法依(yi)規經(jing)營”,“運(yun)(yun)營機(ji)(ji)構(gou)(gou)要(yao)落(luo)實授(shou)(shou)權(quan)(quan)要(yao)求(qiu),規范(fan)運(yun)(yun)營行(xing)為,面向市場公平提供(gong)服務(wu),嚴禁未經(jing)授(shou)(shou)權(quan)(quan)超范(fan)圍使用(yong)數(shu)據(ju)”。《實施規范(fan)》明(ming)(ming)確(que)了(le)“縣級以(yi)(yi)上地(di)方各級人民政府、國家行(xing)業主管(guan)(guan)部(bu)門可將依(yi)法持有的(de)(de)公共數(shu)據(ju)資源”納入授(shou)(shou)權(quan)(quan)運(yun)(yun)營范(fan)圍,明(ming)(ming)確(que)了(le)國家數(shu)據(ju)局、省級數(shu)據(ju)主管(guan)(guan)部(bu)門、國家行(xing)業主管(guan)(guan)部(bu)門數(shu)據(ju)管(guan)(guan)理(li)(li)(li)機(ji)(ji)構(gou)(gou)的(de)(de)管(guan)(guan)理(li)(li)(li)職(zhi)責,并將參與(yu)公共數(shu)據(ju)授(shou)(shou)權(quan)(quan)運(yun)(yun)營的(de)(de)主體分(fen)為“實施機(ji)(ji)構(gou)(gou)”和“運(yun)(yun)營機(ji)(ji)構(gou)(gou)”,分(fen)別明(ming)(ming)確(que)其(qi)職(zhi)責權(quan)(quan)限。

強化資(zi)(zi)源(yuan)管理。針(zhen)對資(zi)(zi)源(yuan)管理,《意見(jian)》提(ti)(ti)出要建(jian)(jian)立公共(gong)數(shu)(shu)據(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)登記制度。公共(gong)數(shu)(shu)據(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)登記是規范授權運營的前提(ti)(ti)和(he)(he)制度保障,以登記為抓手,摸清家底,更(geng)(geng)有(you)效(xiao)地促進供需對接,便于市場(chang)發現高(gao)價值數(shu)(shu)據(ju)(ju)(ju)(ju),催生(sheng)更(geng)(geng)多應(ying)用(yong)場(chang)景(jing)。明確(que)數(shu)(shu)據(ju)(ju)(ju)(ju)源(yuan)頭(tou)治理和(he)(he)質(zhi)量(liang)監督(du)檢查(cha)要求(qiu),壓(ya)實數(shu)(shu)據(ju)(ju)(ju)(ju)提(ti)(ti)供部(bu)門(men)數(shu)(shu)據(ju)(ju)(ju)(ju)治理職責,努(nu)力(li)實現“一(yi)數(shu)(shu)一(yi)源(yuan)”及主數(shu)(shu)據(ju)(ju)(ju)(ju)管理等(deng);構建(jian)(jian)“數(shu)(shu)據(ju)(ju)(ju)(ju)質(zhi)量(liang)、環環有(you)責”的動態持續更(geng)(geng)新(xin)機(ji)制,做好數(shu)(shu)據(ju)(ju)(ju)(ju)質(zhi)量(liang)監督(du)檢查(cha),加強數(shu)(shu)據(ju)(ju)(ju)(ju)質(zhi)量(liang)事(shi)前、事(shi)中(zhong)和(he)(he)事(shi)后監督(du)檢查(cha),努(nu)力(li)做到數(shu)(shu)據(ju)(ju)(ju)(ju)質(zhi)量(liang)可(ke)(ke)反饋、使用(yong)過(guo)程可(ke)(ke)追溯、數(shu)(shu)據(ju)(ju)(ju)(ju)異議可(ke)(ke)處置,從而有(you)效(xiao)提(ti)(ti)高(gao)公共(gong)數(shu)(shu)據(ju)(ju)(ju)(ju)資(zi)(zi)源(yuan)可(ke)(ke)用(yong)性(xing)。

推動措施落實。《意見(jian)》明(ming)確一(yi)系列創新激勵(li)措施,包括(kuo)優化機(ji)構(gou)編制(zhi)資源配置(zhi)、鼓勵(li)先行先試等。支持有條件的(de)(de)地(di)區(qu)和(he)(he)部(bu)門,探索有數據運(yun)(yun)營(ying)職責的(de)(de)事業單位轉企(qi)改制(zhi),成立運(yun)(yun)營(ying)機(ji)構(gou),依法管(guan)理。這(zhe)在一(yi)定程度上意味(wei)著轉企(qi)改制(zhi)后的(de)(de)運(yun)(yun)營(ying)機(ji)構(gou)能(neng)夠開展經(jing)(jing)營(ying)活動,可以按(an)投入和(he)(he)貢獻取得合(he)理的(de)(de)回(hui)報。這(zhe)將極大調(diao)動運(yun)(yun)營(ying)機(ji)構(gou)的(de)(de)積(ji)極性,激發經(jing)(jing)營(ying)動力和(he)(he)運(yun)(yun)營(ying)活力。此外,《意見(jian)》還明(ming)確提出要落實“三個區(qu)分開來”,鼓勵(li)和(he)(he)保(bao)護干部(bu)擔當作為。

公共數據是重要的社會公有財富,與人民群眾生活息息相關。有效利用公共數據已成為各國推進數字化轉型發展的焦點。提高公共數據資源開發利用水平,有利于加快傳統產業轉型升級,優(you)化(hua)(hua)經(jing)濟結構(gou)和運行機(ji)制,有(you)利(li)于(yu)激發市場創新活力,培育數據(ju)產業(ye),形成新的經(jing)濟增長點,有(you)利(li)于(yu)加快政府職能轉變,推進國家(jia)治理體系(xi)和治理能力現代化(hua)(hua)。

政策(ce)恰(qia)逢其時,對公(gong)共數據開發利(li)用系統(tong)部署

黨中央(yang)、國(guo)(guo)務院高度(du)重視公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)資源(yuan)開(kai)(kai)發(fa)(fa)(fa)(fa)利(li)用。習近平總書記(ji)指出(chu),“數(shu)(shu)(shu)據(ju)(ju)(ju)是新的生(sheng)產要素,是基礎(chu)性資源(yuan)和戰略性資源(yuan),也(ye)是重要生(sheng)產力”。黨的二十(shi)屆三(san)中全(quan)會高度(du)關注(zhu)數(shu)(shu)(shu)據(ju)(ju)(ju)要素,提出(chu)“建設(she)和運營國(guo)(guo)家(jia)數(shu)(shu)(shu)據(ju)(ju)(ju)基礎(chu)設(she)施,促(cu)進數(shu)(shu)(shu)據(ju)(ju)(ju)共享”“培育全(quan)國(guo)(guo)一(yi)(yi)體化技術和數(shu)(shu)(shu)據(ju)(ju)(ju)市場”。地(di)方層面,2020年上(shang)海、江蘇、浙江等8個(ge)地(di)區組織開(kai)(kai)展(zhan)為期(qi)兩年的公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)資源(yuan)開(kai)(kai)發(fa)(fa)(fa)(fa)利(li)用試點工(gong)作,取得了(le)預期(qi)效果;全(quan)國(guo)(guo)公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)開(kai)(kai)放水平也(ye)在不(bu)(bu)斷提高,開(kai)(kai)放公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)集數(shu)(shu)(shu)量持(chi)續增(zeng)長(chang);部分有(you)條件的地(di)區、部門(men)開(kai)(kai)展(zhan)了(le)公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)授權(quan)運營實踐。但總體來看,公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)資源(yuan)開(kai)(kai)發(fa)(fa)(fa)(fa)利(li)用還面臨著思(si)想認(ren)識不(bu)(bu)統一(yi)(yi)、安(an)全(quan)權(quan)責不(bu)(bu)清晰及(ji)開(kai)(kai)發(fa)(fa)(fa)(fa)動(dong)力不(bu)(bu)充沛等諸多挑戰。針對這些(xie)突出(chu)問題,國(guo)(guo)家(jia)層面亟需加(jia)強政(zheng)策引(yin)導,完善制度(du)規則,加(jia)快公(gong)(gong)(gong)(gong)共數(shu)(shu)(shu)據(ju)(ju)(ju)資源(yuan)開(kai)(kai)發(fa)(fa)(fa)(fa)利(li)用。

2024年(nian)10月9日,《中(zhong)(zhong)共中(zhong)(zhong)央辦公(gong)(gong)(gong)(gong)廳、國務(wu)院辦公(gong)(gong)(gong)(gong)廳關(guan)于加(jia)快(kuai)公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源開(kai)(kai)發利用(yong)的意見》(以下簡稱《意見》)公(gong)(gong)(gong)(gong)開(kai)(kai)發布。《意見》是(shi)中(zhong)(zhong)央層(ceng)面首次對(dui)公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源開(kai)(kai)發利用(yong)進行系統部署,是(shi)貫徹落實黨的二十屆(jie)三中(zhong)(zhong)全會精(jing)神(shen)的重要舉措,也是(shi)我國數(shu)(shu)據(ju)(ju)(ju)基礎制度建設的重要內容,對(dui)公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源開(kai)(kai)發利用(yong)具(ju)有里程碑意義。該文件以促進公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)合規(gui)高效流(liu)通(tong)使(shi)用(yong)為主線(xian),以提高資(zi)(zi)源開(kai)(kai)發利用(yong)水平為目標,以“激(ji)發共享開(kai)(kai)放(fang)(fang)動力”和“釋放(fang)(fang)市場創新活力”雙力齊發,持(chi)續深化(hua)公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源供給(gei)側(ce)結構(gou)性(xing)(xing)改革,以規(gui)范(fan)公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)授權運(yun)營(ying)為重要抓手,以擴大資(zi)(zi)源供給(gei)、規(gui)范(fan)授權運(yun)營(ying)、鼓勵應用(yong)創新、營(ying)造良好環境、強化(hua)組織保(bao)障(zhang)等(deng)五措并舉,提出了17項具(ju)體措施(shi),打(da)通(tong)公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)流(liu)通(tong)使(shi)用(yong)雙循環,充分發揮公(gong)(gong)(gong)(gong)共數(shu)(shu)據(ju)(ju)(ju)的基礎性(xing)(xing)、先導(dao)性(xing)(xing)作用(yong),推動數(shu)(shu)字經濟高質量發展(zhan)。

堅持(chi)雙力齊發(fa),打造數字經(jing)濟(ji)發(fa)展(zhan)的(de)核心動能

《意見》指出,公(gong)共(gong)數(shu)據(ju)是(shi)國家(jia)重(zhong)要的基礎性戰略資源(yuan)(yuan)(yuan),提高公(gong)共(gong)數(shu)據(ju)資源(yuan)(yuan)(yuan)開(kai)發利(li)用水平,是(shi)深化(hua)數(shu)據(ju)要素(su)市場化(hua)配置改革(ge)的關(guan)鍵舉(ju)措。同時,《意見》強(qiang)調在推(tui)動(dong)公(gong)共(gong)數(shu)據(ju)資源(yuan)(yuan)(yuan)開(kai)發利(li)用中,要“激發共(gong)享開(kai)放動(dong)力(li)”和(he)“釋放市場創新活力(li)”。這實際上明確了數(shu)字經(jing)濟(ji)發展的兩個核心動(dong)力(li)——公(gong)共(gong)數(shu)據(ju)資源(yuan)(yuan)(yuan)有效供(gong)給和(he)創新應用,這也是(shi)解決當前數(shu)字經(jing)濟(ji)發展中供(gong)需(xu)不匹(pi)配問題的關(guan)鍵。

在數(shu)(shu)據(ju)(ju)(ju)供(gong)給(gei)(gei)方面,當前(qian)面臨(lin)較嚴(yan)峻的(de)(de)挑戰,特(te)別(bie)是(shi)公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源(yuan)供(gong)給(gei)(gei)動(dong)力不(bu)足(zu)、數(shu)(shu)據(ju)(ju)(ju)質量不(bu)高(gao)等問題。《意見》明確了(le)共(gong)(gong)享、開(kai)放及授(shou)權(quan)運(yun)營(ying)(ying)三種供(gong)給(gei)(gei)方式,充分(fen)(fen)體現按“需”施策、因“數(shu)(shu)”施策的(de)(de)思路,既(ji)滿(man)足(zu)不(bu)同(tong)的(de)(de)開(kai)發利(li)用(yong)需要(yao),也提出(chu)(chu)針(zhen)對性的(de)(de)管(guan)理(li)要(yao)求(qiu)(qiu),系統(tong)性地解決公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源(yuan)“供(gong)得(de)出(chu)(chu)”的(de)(de)問題。一是(shi)政(zheng)務(wu)(wu)數(shu)(shu)據(ju)(ju)(ju)共(gong)(gong)享。推進跨(kua)(kua)(kua)層級、跨(kua)(kua)(kua)地域(yu)、跨(kua)(kua)(kua)系統(tong)、跨(kua)(kua)(kua)部(bu)(bu)門、跨(kua)(kua)(kua)業務(wu)(wu)政(zheng)務(wu)(wu)數(shu)(shu)據(ju)(ju)(ju)共(gong)(gong)享和業務(wu)(wu)協同(tong),在滿(man)足(zu)政(zheng)務(wu)(wu)部(bu)(bu)門依法履職(zhi)、提升(sheng)管(guan)理(li)和服務(wu)(wu)效(xiao)能的(de)(de)基礎上,實現政(zheng)務(wu)(wu)數(shu)(shu)據(ju)(ju)(ju)的(de)(de)前(qian)置治理(li)和資(zi)(zi)源(yuan)匯聚。二是(shi)公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)開(kai)放。通過建立公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)開(kai)放需求(qiu)(qiu)受理(li)反饋機制(zhi),提高(gao)開(kai)放數(shu)(shu)據(ju)(ju)(ju)的(de)(de)完整性、準確性、及時性和機器(qi)可(ke)讀(du)性,在一定范圍內開(kai)放公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)并提高(gao)可(ke)用(yong)性。三是(shi)公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)授(shou)權(quan)運(yun)營(ying)(ying)。要(yao)求(qiu)(qiu)各地各部(bu)(bu)門探索建立公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)分(fen)(fen)類分(fen)(fen)級授(shou)權(quan)機制(zhi),采取整體授(shou)權(quan)、分(fen)(fen)領域(yu)授(shou)權(quan)、依場景授(shou)權(quan)等模式,授(shou)權(quan)符合條(tiao)件的(de)(de)運(yun)營(ying)(ying)機構(gou)開(kai)展公(gong)共(gong)(gong)數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源(yuan)開(kai)發、產品經營(ying)(ying)和技術(shu)服務(wu)(wu)。《意見》提出(chu)(chu)了(le)運(yun)營(ying)(ying)機構(gou)這(zhe)一概念,對原始數(shu)(shu)據(ju)(ju)(ju)資(zi)(zi)源(yuan)進行(xing)專業化加工處理(li),確保“原始數(shu)(shu)據(ju)(ju)(ju)不(bu)出(chu)(chu)域(yu)、數(shu)(shu)據(ju)(ju)(ju)可(ke)用(yong)不(bu)可(ke)得(de)”,通過數(shu)(shu)據(ju)(ju)(ju)服務(wu)(wu)能力打造(zao),促(cu)進數(shu)(shu)據(ju)(ju)(ju)產品和服務(wu)(wu)面向市場持續供(gong)給(gei)(gei)。

在數據需求應用方面,當前也面臨有效需求不足的問題,特別是有經濟價值的應用場景十分有限。《意見》中從豐富數據應用場景、推動區域數據協作、加強數據服務能力建設、繁榮數據產業發展生態等方面提出具體要求。其中,在豐富數據應用場景方面,《意見》從兩個“鼓勵”和一個“堅持”三個維度提出要“在市場需求大、數據資源多的行業和領域,拓展應用場景”。凸顯應用場景導向,加大“數據要素×”行動力度,鼓勵經營主體利用公共數據資源開發產品、提供服務,推動行業和領域公共數據價值實現;鼓勵和支持企事業單位和社會組織有條件無償使用公共數據開發公益產品,提供便民利民服務;支持人工智能政務服務大模型開發、訓練和應用。這充分釋放了鼓勵企業利用公共數據實現經濟價值的信號,為打通數據應用商業閉環、激發市場創新活力提供了依據。公共數據資源只有與千行百業深入融合才能發揮真正的作用,公共數據資源如同豐富的原材料,各類數據應用場景則是將這些原材料點石成金的大熔爐,必須圍繞國民經濟社會發展、百姓衣食住行、城市社會治理、戰略性新興產業等具體(ti)化(hua)小(xiao)切口場景為突(tu)破,以(yi)“降本提質增效”為核心,推(tui)動數據利(li)用方式向(xiang)共享匯聚和應用服務能力并重的方向(xiang)轉變,促進多元(yuan)數據融合應用,豐富數據產(chan)品(pin)和服務。

規(gui)范(fan)授(shou)權運營,建立合規(gui)高效流通的(de)關鍵機(ji)制(zhi)

作為促進(jin)公(gong)(gong)共(gong)數據合規(gui)高效(xiao)流通使用(yong)的(de)(de)關鍵機(ji)制(zhi)(zhi),《意(yi)見(jian)(jian)》對授權(quan)(quan)運(yun)(yun)營進(jin)行(xing)了(le)深入(ru)描述(shu),這一機(ji)制(zhi)(zhi)也(ye)貫(guan)穿于(yu)《意(yi)見(jian)(jian)》擴(kuo)大供給、規(gui)范(fan)運(yun)(yun)營、鼓勵創新、營造環境(jing)、強(qiang)化保障(zhang)等五方面措施(shi)(shi)的(de)(de)始(shi)終,將對各(ge)地方各(ge)部(bu)門(men)開展公(gong)(gong)共(gong)數據授權(quan)(quan)運(yun)(yun)營工作給予指導(dao)。關于(yu)公(gong)(gong)共(gong)數據授權(quan)(quan)運(yun)(yun)營機(ji)制(zhi)(zhi),目前已經有部(bu)分地方和部(bu)門(men)開展了(le)相關實(shi)(shi)踐探(tan)索。《意(yi)見(jian)(jian)》在(zai)給出(chu)指導(dao)性要求(qiu)的(de)(de)同時,也(ye)給予了(le)各(ge)地各(ge)部(bu)門(men)創新探(tan)索的(de)(de)空間(jian)。10月12日,國家數據局(ju)就《公(gong)(gong)共(gong)數據資源授權(quan)(quan)運(yun)(yun)營實(shi)(shi)施(shi)(shi)規(gui)范(fan)(試行(xing))》(以下簡稱《實(shi)(shi)施(shi)(shi)規(gui)范(fan)》)面向公(gong)(gong)眾公(gong)(gong)開征求(qiu)意(yi)見(jian)(jian),該文件對于(yu)授權(quan)(quan)運(yun)(yun)營機(ji)制(zhi)(zhi)的(de)(de)落地實(shi)(shi)施(shi)(shi)給出(chu)了(le)明確要求(qiu)。
